Agreement to Terms

By downloading, installing, or using the My Moods mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may:

• Use the App on devices you own or control
• Create personal audio presets and configurations
• Use the App's features as intended

This license does not include the right to:

• Resell, redistribute, or commercially exploit the App
• Modify, reverse engineer, or create derivative works
• Extract or use audio content outside the App

Intellectual Property Rights

The App and all its content, including but not limited to software, audio files, graphics, text, and user interface elements, are owned by Thomas Walravens or its licensors and are protected by copyright, trademark, and other intellectual property laws.

All audio content, sound effects, and ambient sounds included in the App are licensed for use solely within the App. You may not extract, copy, or use these audio files outside of the App environment.

Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

Public Sharing of User Content via Web Platform

The App may provide functionality that enables you to share your custom mood configurations, audio presets, and related content (“User Moods”) via a web-based platform or hub accessible to the general public worldwide (“Web Hub”).

BY UTILIZING THE “SHARE MY MOODS” FEATURE OR ANY SIMILAR FUNCTIONALITY TO UPLOAD OR PUBLISH YOUR USER MOODS TO THE WEB HUB, YOU HEREBY:

(a) Consent to the collection and public display of the following information:

• The file name you assign to your mood pack (JSON file)
• The display name you assign to your mood pack
• The custom names you have given to individual moods within your pack
• The author name you choose to identify yourself as the creator
• The audio configuration and settings contained in your mood pack

(b) Grant us and other users a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right and license to use, reproduce, display, distribute, and make available your User Moods through the Web Hub and related services;

(c) Acknowledge and agree that all information specified in subsection (a) above will be accessible to the public at large without restriction and may be viewed, downloaded, copied, and utilized by any third party who accesses the Web Hub;

(d) Represent and warrant that you have all necessary rights to share the User Moods and that such sharing does not violate any third-party rights or applicable laws;

(e) Acknowledge that you are sharing your User Moods without any expectation of compensation, remuneration, or attribution, and that no payment or consideration shall be due to you from us or any third party for the use of your shared content;

(f) Understand and accept that once User Moods are published to the Web Hub, you may not be able to control their subsequent use, distribution, or modification by third parties;

(g) Waive any moral rights or rights of attribution you may have in the User Moods to the extent permitted by applicable law.

We strongly recommend that you do not include personal or identifying information in mood names, pack names, or author names if you wish to maintain anonymity. For complete details on data handling, please refer to our Privacy Policy.

We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Moods shared via the Web Hub at our sole discretion, including content that violates these Terms or is otherwise objectionable. You acknowledge that we are not responsible for third-party use of your publicly shared User Moods and release us from any liability arising from such use.

Disclaimers and Limitations of Liability

Termination

These Terms remain in effect until terminated. You may terminate your use of the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the App will cease immediately, and you must delete all copies of the App from your devices.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
